Criminal DUI Penalties

 
 

Las Vegas DUI Punishments Following a Conviction:
Conviction of a Third Offense DUI is a felony. Also, causing substantial bodily harm or death while under the influence is a felony.
Conviction of a First Offense DUI is a misdemeanor in Nevada, and will likely involve the following penalties:

 

1st Offense with a BAC of 0.08 to 0.179:

  • Minimum of 2 days in jail or 48 to 96 hours of community service; to a maximum of 6 months in jail;
  • A fine of $400 to $1,000, plus additional court fees and costs;
  • Completion of DUI school;
  • Attendance at MADD's Victim Impact Panel;
  • Mandatory 90-day revocation of one's driving privileges; and* possibly ordered to install a "breath ignition lock device" on your vehicle for 3 to 6 months.
 

1st Offense with a BAC of 0.18 or higher:

  • The above, plus an evaluation for addiction and completion of substance abuse counseling; and
  • Mandatory installation of a "breath ignition lock device" on your vehicle for a period of 12 to 36 months.
 

2nd Offense with a BAC of 0.08 to 0.179

A second conviction within 7 years of the conviction date of the first offense requires greater punishment than a first offense. With a BAC of less than 0.18, the law requires:

  • Minimum of 10 days jail, but not more than 6 months in jail;
  • A fine of $750 to $1,000, plus additional court fees and costs;.
  • Attendance at MADD's Victim Impact Panel;
  • An evaluation for addiction and completion of substance abuse counseling;
  • Mandatory 360 day revocation of one's driving privileges; and
  • Possibly ordered to put a "breath ignition lock device" on your vehicle for 3 to 6 months at your own expense.
 

A 2nd Offense with a BAC of 0.18 or greater

  • Requires the above, plus mandatory installation of a "breath ignition lock device" on your vehicle for a period of 12 to 36 months at your own expense.
 

3rd Offense

A third offense is a non-probationable felony offense, requiring imprisonment of no less than 1 year and no more than 6 years.
