What to do after a DUI Arrest

You get released from jail following a DUI arrest in Las Vegas. You go home and catch up on the sleep you missed while in custody. You were given your return court date, but that is about all that you know.

What should you do now?
You should spend as much time on this website as it takes to fully understand what you are up against and how you might be able to beat the charge. It is so very important to hire a true DUI attorney in order to enhance your chances of beating the DUI / DWI / BUI charge.
But generally speaking, just do the following:

  • Find someone who saw you before or during your arrest
  • Write down everything that you had eaten and drank before the arrest
  • Consult with a True Las Vegas DUI Attorney
  • Contact the Nevada DMV

Contact any friends or family that may be able to testify as to your lack of impairment around the time of the arrest. Often the arresting officer will write a DUI/DWI arrest report to support his decision to arrest you when in reality the arrest may have not be warranted under the law. This could aid a True DUI Attorney attack the validity of the arrest and prevent a conviction.

The accuracy of the blood and breath tests is sometimes affected by how much you drank and ate. A True DUI Attorney wants to see if your self-reported drinking actually correlates to the BAC number or is there a "disconnect". Sometimes a disconnect between the BAC and what was consumed allows a True DUI Attorney to assert defenses against the charge of DUI.

Beating a DUI charge in Las Vegas is difficult, but possible. Find a True DUI Attorney and tell that attorney if you are diabetic, have GERD (gastroesophageal reflux disease), had a fever when arrested, have collapsing veins or work with or around volatile organic compounds. This could lead to an effective defense to the charge of DUI.

Upon notice of revocation of your driver's license, contact the DMV and request your “due process” administrative hearing. Your license cannot be revoked (if you request the hearing) until the officer testifies as to why he or she arrested you for suspicion of DUI. It can also be a good opportunity to learn what the officer is going to testify to at trial. Best of all, if the officer fails to appear at the hearing within 10 or 15 minutes, ask the judge to dismiss the matter and your license will not be revoked.
